These Terms of Service (“Terms”) govern your use of the Pledgely.co service (“Pledgely.co”, “Service”, “we”, “us”).
By accessing or using Pledgely.co, you agree to these Terms.
If you do not agree, do not use the Service.
1. What Pledgely.co Is (and Is Not)
Pledgely.co is a memory tool for recording agreements and intentions.
It is not:
- a task manager,
- a productivity system,
- a contract enforcement tool,
- a reminder service with follow-ups,
- a system that evaluates, pressures, or judges behavior.
Pledgely.co records context and sends at most one neutral reminder at a chosen check-in time.
What happens before or after that reminder is entirely up to the people involved.
2. Eligibility
Pledgely.co is not intended for children under the age of 13.
By using the Service, you confirm that you are at least 13 years old and legally able to enter into these Terms.
3. Accounts and Access
3.1 Account creation
You access Pledgely.co using your email address and a one-time passcode (OTP).
You are responsible for maintaining access to your email account.
3.2 Trusted devices
Pledgely.co may remember a device to reduce repeated sign-in prompts.
You are responsible for securing devices you use to access the Service.
3.3 Account responsibility
You are responsible for all activity associated with your account.
If you believe your account access has been compromised, contact us at feedback@pledgely.co.
4. Recording Pledges
4.1 Your responsibility
When you record a pledge, you are responsible for:
- the content you write,
- the accuracy of participant email addresses,
- ensuring that you have a legitimate reason to record the pledge.
Pledgely.co does not verify the accuracy of pledges.
4.2 Pledges involving other people
You may record pledges that involve other people by email.
Important rules:
- No notification is sent at the time of creation.
- At the check-in time, Pledgely.co may send one neutral reminder.
- Other participants may block all pledge messages or block specific senders.
- Pledgely.co does not guarantee that another person will receive a reminder.
- Recording a pledge does not create a contract, obligation, or duty enforceable by Pledgely.co.
5. Boundaries and Blocking
Pledgely.co allows people to:
- block all incoming pledge messages,
- block or allow specific senders.
These boundaries are respected automatically and silently.
You agree not to attempt to bypass another person’s boundaries using Pledgely.co or any related mechanism.
6. Notifications and Emails
6.1 Reminder behavior
For each pledge, Pledgely.co sends no more than one reminder at the selected check-in time.
There are:
- no follow-ups,
- no overdue alerts,
- no repeated messages.
6.2 No guarantee of delivery
Email delivery depends on external systems.
Pledgely.co does not guarantee that emails will be delivered, received, read, or acted upon.
7. Content Ownership
You retain ownership of the content you enter into Pledgely.co.
By using the Service, you grant DerekhPath LLC a limited license to store, process, and display your content solely for operating Pledgely.co.
We do not claim ownership of your pledges.
8. Acceptable Use
You agree not to use Pledgely.co:
- to harass, pressure, shame, or intimidate others,
- to impersonate another person,
- to send unwanted or abusive messages,
- to violate any applicable law.
We may restrict or terminate access if the Service is used in a way that harms others or undermines its purpose.
9. Data and Deletion
Your data is handled according to our Privacy Policy.
At this time, account and data deletion is handled by request only.
You may request deletion via the feedback form or by emailing feedback@pledgely.co.
10. Service Availability
Pledgely.co is provided on an “as is” and “as available” basis.
We do not guarantee:
- uninterrupted availability,
- error-free operation,
- that reminders will occur at an exact moment,
- that the Service will meet every expectation or use case.
We may modify, suspend, or discontinue parts of the Service at any time.
11. No Professional or Legal Advice
Pledgely.co does not provide legal, financial, therapeutic, or professional advice.
Recorded pledges are not legal contracts, and Pledgely.co does not validate or enforce agreements.
12. Limitation of Liability
To the fullest extent permitted by law:
DerekhPath LLC shall not be liable for:
- missed or forgotten reminders,
- actions or inactions of other people,
- reliance on pledges recorded in the Service,
- indirect, incidental, or consequential damages.
Your use of Pledgely.co is at your own discretion and risk.
13. Indemnification
You agree to indemnify and hold harmless DerekhPath LLC from claims arising out of:
- your use of the Service,
- content you record,
- violations of these Terms.
14. Termination
You may stop using Pledgely.co at any time.
We may suspend or terminate access if:
- these Terms are violated,
- the Service is used abusively or unlawfully,
- required by law.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
16. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we will update the effective date and publish the revised Terms on the website.
Continued use of the Service after changes constitutes acceptance of the updated Terms.
